What if an employee has a medical marijuana card? How does that affect your drug-free workplace?
According to the latest legislature, an employer does not have to accommodate medical marijuana in the workplace or an employee under the influence of marijuana.
The medical marijuana approval in Florida does not override the rules around a drug-free workplace which are basically:

- If you test positive at the time of injury, the claim can be denied.
Medical marijuana card or not, nothing has changed in regard to a Florida drug-free workplace.
It’s still against Federal Law. There are still OSHA implications. And whether a carrier will pay for a claim is entirely up to the carrier.
